Terms of Service

1. Acceptance of Terms
By accessing or using the OfferCasting ("Platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of Service
OfferCasting is a multi-tenant SaaS platform that enables creators and marketers to generate viral content using AI agents, manage Instagram publishing pipelines, and analyze content performance. Access is granted through a valid Whop membership.
3. Account Access & Eligibility
Access to the Platform requires a valid, active membership purchased through Whop.com. You must be at least 18 years of age. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree not to use the Platform to violate any applicable law; infringe on any third-party intellectual property rights; generate spam, misinformation, or content designed to deceive; violate Instagram's Terms of Service or Meta's Platform Policies; or attempt to reverse-engineer, scrape, or resell the Platform.
5. Instagram & Third-Party Integrations
The Platform connects to Instagram via the official Meta Graph API. You are responsible for ensuring your use of connected accounts complies with Meta's Terms of Service. We are not responsible for account restrictions, suspensions, or actions taken by Meta.
6. AI-Generated Content
Content generated by AI agents on the Platform is provided as-is. You are solely responsible for reviewing, editing, and approving all content before publication. We make no warranty that AI-generated content is accurate, appropriate, or effective.
7. Payment & Billing
Subscriptions are managed entirely through Whop.com. By subscribing, you agree to Whop's payment terms. We do not store payment card information. Plan tiers (Starter, Pro, Agency) determine feature access and account limits.
8. Data & Privacy
We collect and process data as described in our Privacy Policy. You retain ownership of all content you generate using the Platform. By using the Platform, you grant us a limited license to process your data to provide the service.
9. Termination
We reserve the right to suspend or terminate your access if you violate these Terms or if your Whop membership lapses. Upon termination, your access to the Platform will cease immediately.
10. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including loss of revenue, lost data, or business interruption.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms.
